In 1931 he pleaded guilty to killing a Black bootlegger and received a suspended sentence. In 1936 he shot and killed a rival operator in Dallas, surrendered to police and claimed self-defense; the district attorney declined to prosecute. Asked years later whether he had bribed the district attorney, Binion answered: “Well, I don’t know. Maybe I had.” [8] PBS reports that many killings in Dallas in the 1930s and 1940s were attributed to him. [9]

In 1946 Dallas voters elected a reform sheriff, and Binion left Texas for Las Vegas with his wife and five children. [8] He summed it up later: “My sheriff got beat in the election.” [7]

Binion’s Horseshoe

In Las Vegas he first became a partner in the Las Vegas Club with J. Kell Houssels. In 1951 he took over the El Dorado on Fremont Street and renamed it Binion’s Horseshoe Club. [7] The Horseshoe became known for free drinks and for accepting any bet a player put on the table, and in the 1960s it displayed $1 million in $10,000 bills in a horseshoe-shaped case for tourists to be photographed with. [9]

In 1953 Binion was indicted for failing to pay $862,000 in taxes. He pleaded guilty and was sentenced to five years in the federal penitentiary at Leavenworth, Kansas. [8] He was released in 1957 after serving three and a half years. [10] To pay for his legal fight he sold his controlling interest in the Horseshoe; the family later regained control, but Binion was never again issued a gambling license. Swanson reported FBI memos showing that the bureau reclassified Binion as a criminal informant on March 2, 1960. Benny and his son Jack attended. When Moore said he did not plan to repeat the event, Benny asked whether he would mind the Horseshoe hosting a similar annual gathering, and Moore agreed. [4] PokerNews notes that while many accounts credit Binion with the idea, it was Moore who “really got the ball rolling”. [5] Card Player quotes Binion telling Amarillo Slim: “That was a good thing up there in Reno.
